Arrêt de la Cour européenne de Justice

Le 27 octobre 2016, la Cour européenne de Justice a rendu une décision selon laquelle le gouvernement wallon (Belgique) a agi illégalement en créant une « norme sectorielle » visant à faciliter considérablement le déploiement de parcs éoliens en Wallonie sans en informer correctement le grand public, et sans lui demander son avis sur la question conformément à la directive européenne 2001/48/CE.

C’est un succès majeur pour ceux qui s’opposent aux parcs éoliens terrestres dans la mesure où la décision de la CEJ est immédiatement applicable à toutes les législations similaires dans tous les États membres. L’article 2, sous a), et l’article 3, paragraphe 2, sous a), de la directive 2001/42/CE du Parlement européen et du Conseil, du 27 juin 2001, relative à l’évaluation des incidences de certains plans et programmes sur l’environnement, doivent être interprétés en ce sens qu’un arrêté réglementaire, tel que celui en cause au principal, comportant diverses dispositions relatives à l’installation d’éoliennes, qui doivent être respectées dans le cadre de la délivrance d’autorisations administratives portant sur l’implantation et l’exploitation de telles installations, relève de la notion de « plans et programmes », au sens de cette directive.

Considérant l’importance de la décision de la CEJ (notez que les gouvernements français et néerlandais et la Commission européenne avaient rejoint le gouvernement wallon contre les citoyens plaignants), il serait opportun que chacun de vous diffuse l’information aussi largement que possible dans son propre pays.

European Court of Justice

On October 27, 2016, the European Court of Justice has issued a ruling whereby the Walloon government (Wallonia, Belgium) has acted unlawfully in creating a “norme sectorielle” aimed at considerably facilitating the deployment of wind farms in Wallonia without properly informing the general public and asking their opinion on the matter as required by the European directive 2001/48/CE.

This is a major success for those opposing onshore wind farms as the ECJ ruling is immediately applicable to all similar legislations in all the Member States. For additional information, please go to the ECJ website and look for case C-290/15 (d’Oultremont et al. vs Walloon Government).

Articles 2(a) and 3(2)(a) of Directive 2001/42/EC of the European Parliament and of the Council of 27 June 2001 on the assessment of the effects of certain plans and programmes on the environment must be interpreted as meaning that a regulatory order, such as that at issue in the main proceedings, containing various provisions on the installation of wind turbines which must be complied with when administrative consent is granted for the installation and operation of such installations comes within the notion of ‘plans and programmes’, within the meaning of that directive.

Considering the importance of the ECJ ruling (note that the French and Dutch governments and the European Commission had joined the Walloon government against the plaintiff citizens), it might be appropriate that each of you communicates the information as widely as possible in your own country.
