Polish Parliament adopts mandatory setback for industrial wind turbines (10 times turbine height)

 

On 9 June Polish Senate approved the bill providing for mandatory setbacks of new wind farm developments from residential housing, which had already been passed by the Lower House several weeks ago. To become law, the legislation must now be signed by Polish President Andrzej Duda and officially published. The law is expected to come into effect as from 1 July 2016.

This new regulation affects rural communities in a number of important ways:

- future wind farms may be sited exclusively on the basis of local “spatial development” plans as adopted by municipality councils. Formerly wind farms could be approved by individual decisions of local authorities (mayors);

- the law provides for mandatory setbacks for industrial wind turbines of 10 times turbine height (total height of a wind turbine, including the blades) from residential housing and “valuable natural areas”, such as Natura 2000 and national parks. Formerly there have been no formal planning requirements in this respect;

- it introduces a new definition of “building structure” into Polish law. The entire wind turbine is now defined as a “building structure”. Formerly the blades and the turbine were not treated as the structure’s components and as such not subject to any technical supervision;

- the law transfers the authority to issue environmental permits from municipal authorities to regional government agencies specialising in environmental protection issues (Regional Environmental Protection Directors).

It needs to be noted that this legislation does not provide for the liquidation of any existing wind farms, does not affect in any way the current operation of these plants or the public subsidy system for industrial wind energy.

A recent report by the Polish National Auditor (NIK) analysed the failure to safeguard the public interest in local planning and approval processes for wind farms. Based on a multi-year inquiry covering 70 local and county level authorities, the report identified massive conflicts of interest (wind farms being sited on lands owned by local officials approving the projects), other widespread violation of local government laws, the lack of proper measurement of sound emissions from wind farms, and failures to properly consult with local communities about the projects.

The Polish Public Health Institute (PIZP-PZH) issued a recommendation that wind farms should be located at least 2 kilometres from people’s residences, citing a comprehensive review of current scientific publications (close to 500 items) and the precautionary principle that is part of the EU law.

Le Parlement polonais adopte la règle 10H obligatoire pour les éoliennes industrielles (10 fois la hauteur de la turbine)

 
Le 9 Juin le Sénat polonais a approuvé le projet de loi prévoyant des distances  obligatoires par rapport aux habitations , pour les  nouveaux projets éoliens en développements , celles –ci avaient déjà été adoptées par la Chambre basse, il y a plusieurs semaines. Pour devenir une loi, ce texte  doit maintenant être signé par le président polonais Andrzej Duda et officiellement publié. La loi devrait entrer en vigueur à compter du 1er Juillet 2016.

Cette nouvelle réglementation affecte les communautés rurales dans de façons importantes:

- Les futurs parcs éoliens peuvent être situés exclusivement sur la base des plans locaux de développement du territoire  adoptés par les conseils municipaux. Autrefois les parcs éoliens pouvaient être approuvés par des décisions individuelles des autorités locales (maires);

- La loi prévoit des distances  obligatoires pour les éoliennes industrielles de 10 fois la hauteur de la turbine (de hauteur totale d'une éolienne, y compris les lames) par rapport aux logements résidentiels et des «zones naturelles protégées», tels que Natura 2000 et les parcs nationaux. Autrefois il y avait  aucune exigence de planification formelle à cet égard;

- Elle introduit une nouvelle définition de « structure de bâtiment » dans le droit polonais. L'éolienne entière est désormais définie comme une «structure de bâtiment". Autrefois, les lames et la turbine n’étaient pas traités comme des composants de la structure et en tant que telle, n’étaient soumises à  aucune supervision technique;

- La loi transfère le pouvoir de délivrer des permis environnementaux des autorités municipales aux agences régionales gouvernementales spécialisées dans les questions de protection de l'environnement (directeurs régionaux de protection de l'environnement).

Il convient de noter que cette loi ne prévoit pas la fin  de tous les parcs éoliens existants, ne modifie en aucune manière le fonctionnement actuel de ceux-ci ni  le système de subventions publiques pour l'énergie éolienne industrielle.

Un récent rapport du « Polish National Auditor » (NIK) a pointé analysé l'omission de protéger l'intérêt public dans les processus de planification et d'approbation locaux des parcs éoliens. Sur la base d'une enquête pluriannuelle concernant 70 autorités au niveau local et des comtés, le rapport a identifié des conflits massifs d'intérêts (parcs éoliens étant situés sur des terres appartenant à des responsables locaux qui ont approuvé ces  projets), mais aussi une violation généralisée des lois du gouvernement local, le manque de mesures exactes  des émissions sonores des éoliennes, et les échecs de la consultation  correcte des communautés locales sur les projets.
DE son côté le Polish Public Health Institute  (PIZP-PZH) a émis une recommandation pour que les parcs éoliens soient situés plus de  2 kilomètres des habitations, en publiant un rapport  exhaustif des publications scientifiques actuelles (près de 500 articles) et mis en avant le principe de précaution qui fait partie de la législation de l'UE.

Das Polnische Parlament verabschiedet verbindliche Abstandsregelung für industrielle Windenergieanlagen des 10-fachen der Anlagenhöhe

 

Am 9. Juni bestätigt der polnische Senat den Gesetzentwurf zur Regelung der Abstände von neuen Windpark-Projekten zur Wohnbebauung, der bereits vor einigen Wochen vom Unterhaus verabschiedet worden war. Um Rechtskraft zu erlangen, muss das Gesetz jetzt durch den polnischen Präsidenten Andrzej Duda unterzeichnet und dann veröffentlicht werden.
Das Gesetz wird voraussichtlich mit dem 1. Juli 2016 in Kraft treten.

Diese neue Verordnung betrifft ländliche Gemeinden auf vielfältige Weise:

  • Künftige Windparks können in Zukunft nur noch auf der Grundlage lokaler Raumentwicklungspläne (in D: Landesentwicklungspläne, Regionalpläne) gebaut werden, entsprechend der Verabschiedung durch Gemeindevertretungen. - Früher konnten Windparks mittels individueller Entscheidungen lokaler Behörden und der Bürgermeister genehmigt werden.

  • Das Gesetz sieht verbindliche Abstände von industriellen Windkraftanlagen zu Wohnhäusern und schützenswerten Naturgebieten, wie z.B. Natura 2000 und Nationalparks von 10facher Gesamthöhe der WEA (Nabenhöhe + Rotorlänge) vor. - Früher gab es keinerlei planerische Vorgaben in dieser Hinsicht.

  • Es wird eine neue Definition von Windkraftwerken als Ganzes im polnischen Recht geben. Die gesamte Windturbine wird nun als ein Bauelement definiert. - Rotorblätter und Generatoren wurden bisher nicht als strukturelle Bestandteile gewertet und waren dadurch auch nicht Gegenstand einer technischen Überwachung.

  • Das Gesetz überträgt die umweltbehördlichen Genehmigungen von den kommunalen Behörden auf regionale Regierungsbehörden, spezialisiert auf Fragen des Umweltschutzes (regionale Umweltschutzdirektoren - in D. vergleichbar mit Umweltbehörden des Landes).

Es wird darauf hingewiesen, dass diese Regelung weder den Rückbau bestehender Windparks veranlasst, noch wirkt sich auf den den aktuellen Betrieb bestehender WEA, bzw. auf das öffentliche Subventionssystem für die industrielle Windenergie aus.
Ein kürzlich veröffentlichter Bericht des Polnischen National Revisors (NIK) wies auf die Notwendigkeit von Gegenmaßnahmen zur Sicherung des öffentlichen Interesses an lokalen Planungs- und Genehmigungsverfahren für Windparks hin. Auf der Grundlage einer mehrjährigen Untersuchung von 70 Behörden auf kommunaler und Kreisebene, identifizierte der Bericht massive Interessenkonflikte (z.B. werden Windparks auf Ländereien von ortsansässigen Beamten errichtet, die sich das Projekt selber genehmigen). Andere weit verbreitete Verletzungen der gesetzlichen Regeln sind z.B. das Fehlen korrekter Messungen der Schallemissionen von Windparks und das Versäumnis, die Gemeinden vor Ort ordnungsgemäß über die Projekte zu informieren.

Das polnische Institut für Volksgesundheit (PIZP-PZH) hatte eine Empfehlung ausgesprochen, dass Windparks mindestens 2 Kilometer von der Wohnbebauung entfernt stehen sollten. Dazu hatte die oberste Gesundheitsbehörde Polens eine Überprüfung von fast 500 Artikel umfassenden, aktuellen wissenschaftlichen Publikationen vorgenommen und beruft sich außerdem auf das Vorsorgeprinzip, welches Teil des EU-Rechts ist.

Komunikat prasowy w związku z uchwaleniem ustawy odległościowej

W dniu 9 czerwca 2016 r., polski parlament ostatecznie zakończył pracę nad ustawą regulującą minimalną odległość nowo budowanych elektrowni wiatrowych od zabudowy mieszkaniowej. Ustawa czeka jeszcze na podpis Prezydenta Andrzeja Dudy i oficjalną publikację. Spodziewamy się, że ustawa zacznie obowiązywać od 1 lipca 2016 r.

Nowa regulacja prawna zawiera kilka ważnych zmian dla społeczności lokalnych:

- wprowadza obowiązek lokalizacji na podstawie miejscowych planów zagospodarowania przestrzennego, uchwalanych przez rady gmin. Dotychczas można to było robić na podstawie indywidualnych decyzji o warunkach zabudowy wydawanych przez władze lokalne (wójtów/burmistrzów/prezydentów),

- wprowadza do procesu lokalizacji elektrowni wiatrowych minimalną odległość 10 x H (wysokość całkowitą elektrowni wiatrowej) od zabudowy mieszkaniowej i obszarów cennych przyrodniczo (np. Natura 2000 i parki narodowe). Dotychczas nie było żadnego wymogu w tej sprawie,

- wprowadza nową definicję budowli w prawie, polskim obejmującą całą elektrownię. Dotychczas śmigła i turbina w ogóle nie były traktowane jako elementy budowlane i nie podlegały żadnemu nadzorowi,

- przekazuje prawo do wydawania decyzji środowiskowych uwarunkowaniach z poziomu władz gminnych do regionalnych władz rządowych wyspecjalizowanych w sprawach z zakresu ochrony środowiska (Regionalny Dyrektor Ochrony Środowiska).

Ustawa nie przewiduje likwidacji obecnych farm wiatrowych, zmian w zakresie ich funkcjonowania, ani też w sprawach dotacji dla energetyki wiatrowej. Ustawa nie reguluje też nadzoru technicznego nad działającymi już elektrowniami wiatrowymi oraz spraw związanych z aspektami środowiskowymi ich funkcjonowania. Sprawy te wymagają odrębnych zmian w przepisach.
